Personal data has been collected in order to serve this Penalty Charge Notice and enforce the parking terms and conditions.  As a contravention has occurred, your personal data may be collected, processed, shared and retained in order to carry out the performance of public task and fulfil our legal obligations in the following ways:

  • to request details of the registered keeper of the vehicle from the DVLA in order to pursue a Penalty Charge Notice
  • shared with third parties for appeals and enforcement
  • shared with the police or security organisations to prevent or detect crime

Your data rights

In relation to the personal data which we may hold about you, you have the right to request to be informed, have access or rectify incorrect information.  You also have the right to object to or restrict our processing of your data.  Under Data Protection law we must verify your identity and explain to you our reasons if we do not agree to agree to carry out your request.

Using your personal information: Spelthorne Borough Council will use the information, including personal data, it collects (including the vehicle registration) to obtain the name and address of the registered keeper if this PCN remains unpaid.

The Traffic Management Act 2004 (Part 6) requires us to do this and such processing will therefore be carried out in accordance with prevailing statutory obligations. The Council does not need your permission to process this information for this purpose.

The personal information will be used by the Council's parking and enforcement teams and may be shared with its parking enforcement contractors We will take appropriate steps to make sure we hold records about you electronically in a secure way and will only make them available to those who have a right to see them and in compliance with data protection legislation.

The personal information will be retained for 2 years following the completion of processing. The information may be disclosed to other

Enforcement agencies and third parties where it is necessary and lawful to do so eg for the prevention and detection of crime.
