Local Land Charges

At present, due to Covid-19 outbreak, we are unable to accept search requests via the post and payment by cheque.

Search requests can be made via email or electronically (via either the NLIS Hub (National Land Information Service) TM Group  OR INFOTRACK

Email requests should be sent with one copy each of LLC1, location Plan and CON 29 forms and provide a direct dial telephone number in order that we may ring for payment after checking the search details are correct.

HUB requests should be sent with one copy each of LLC1, location Plan and CON 29 forms and payment is made by BACS.

Please note that we will try to keep to our normal turn-around times but these may need to change depending on circumstances at the time and we will update our webpages as appropriate.

The Local Land Charges Department undertakes local searches on a property or land which you may be thinking of buying as well as on surrounding areas. These are usually requested by a solicitor who can explain the results to you.

Information is provided about matters which may affect the property for example planning applications, enforcement notices, building regulations, whether the property is in a conservation area or whether there are any major developments planned.

How much will it cost?

All cheques should be made payable to 'Spelthorne Borough Council'. Please note that client or individual cheques cannot be accepted. You can also pay by Credit or Debit card. Please email us the paperwork for the search - we will then check the search and call to take payment. We are now able to return Searches electronically via either the NLIS Hub (National Land Information Service) or TM Group.

What forms do I need to complete?

Please be advised that once a search has been accepted for processing, regretfully, it cannot be cancelled. Two sets of forms make up the search - LLC1 and CON29.

When applying for a search, please ensure the following is sent:

  • the LLC1 and CON29 forms if you require answers to both, in duplicate if via the post;
  • the correct fee - this Authority does not accept personal cheques. All cheques should be make payable to the Spelthorne Borough Council and cannot be post dated;
  • a clear address indicating the property being searched and a Land Registry filed plan outlining the property in red

The LLC1 deals with information from the Local Land Charges register. The register contains important information about the property, which might affect what you can do with it currently or in the future, and you need to be aware of this before you buy. Significant information such as:

  • financial charges (registered against the property by the Local Authority);
  • planning agreements;
  • tree preservation orders;
  • enforcement notices;
  • conditional planning consents;
  • improvement grants;
  • smoke control orders;
  • buildings of special architectural and historic interest

The CON29 deals with supplementary information held by the Local Authority. The information is very comprehensive and provides essential answers about the property, such as:

  • Is there going to be a major highway running through the property?
  • Is the road in front of the property maintained at public expense or will you have to maintain it?
  • Is there a contravention in relation to a building Regulation affecting the property?

There are 64 replies to standard questions given in CON29 form R. There are also optional enquiries (CON29 form O) should you require more information. The Commons Registration Searches question is now part of the CON290 form sent to Local Land Charges department initially and answered by Surrey County Council.
